Terms and conditions of hosting

Technical support for hosting

Customers who purchase hosting for web sites, email and related services are deemed to have accepted the terms and conditions as herein stated by virtue of their using the service for which they have subscribed.

B2B Web Consultants will, as part of the package of services on offer, provide technical support to its hosting subscribers in the use of the DirectAdmin control panel and such procedures as are available through the DirectAdmin control panel.

Our technical support is limited to those services which are inherently a part of the hosting package that is accessible via the DirectAdmin control panel. The provision of technical support for third party clients, applications, programs and packages that are not directly connected with or accessible through the DirectAdmin control panel is expressly excluded from the technical support service offered with the hosting service provided.

B2B Web Consultants will provide hosting subscribers with a hosting manual that contains will necessary instructions about the operation of those services which are access able through the DirectAdmin Control panel and will also provide additional help and advice for its subscribers through this web site.

B2B Web Consultants will not be liable for any loss, damage or disadvantage arising from third party clients, applications, programs and packages which are not directly under its control.

B2B Web Consultants reserves the right to withdraw a hosting subscription if the customer fails to pay the asked for fee within a reasonable period of time or if the customer is found to have breached any of the terms and conditions herein stated.

General terms and conditions for the provision of hosting services

The use of the word “he” is this document implies both the masculine and feminine
genders.

The following constitute the terms and conditions under which B2B Web
Consultants trades and supplies its services and related products. These
conditions, in conjunction with our general terms and conditions of trade represent
the totality of the agreement and form the Contract between us and the customer.

Any agreed variation or alteration to part of these terms and conditions will not
invalidate the remainder or the whole. B2B Web Consultants is entitled to suspend
its provision of services if the customer does not adhere to any or several
conditions of this service.

Any customer hiring web site hosting from B2B Web Consultants shall as a
condition of such hiring agree to abide by the conditions of service set out below.
Failure to observe and keep to these conditions may render the customer liable to
termination of service without refund or restitution of any kind.

The customer shall be deemed to have accepted these conditions of service by
directly or indirectly using the hosting service provided or through the actions of
any person acting on his behalf in using the service.

The hosting service is provided for the exclusive use of the customer and must not
be resold, subcontracted or assigned to any third party.

The customer may only allow a third party to use the hosting service or have to
access to it if that third party is a web designer acting on behalf of the customer in
the design and publication of a web site which is for the benefit of the customer. The customer agrees and warrants that he will not hold B2B Web Consultants liable for any jeopardy, damage, risk or injury arising from his direct use of the hosting service or by allowing any third party to use or to have access to the hosting service provided whether such third party is acting on his behalf or not.

A customer or any person acting on his or their behalf must not upload on to our
web space any material, file or content which shall under the laws of the United
Kingdom be deemed to be illegal or contrary to any Act of Parliament.

The customer or any person acting on his behalf must not use the hosting service
to send or to receive any material that is illegal, offensive, abusive, obscene,
indecent, pornographic, menacing, inducing hatred of any kind or that is in breach
of copyright, confidence, privacy, intellectual property rights or other kinds of rights
as defined by criminal or civil law of the United Kingdom, nor any material that is likely to cause annoyance, needless anxiety or undue stress to any third party or
which is in conflict with or breach of conditions or service or acceptable use
policies of any connected networks or service providers through which the hosting service provided by us becomes available to the customer.

The customer represents, undertakes and warrants to us that he will use the
hosting service allocated to him only for lawful purposes. In particular, he
represents, warrants and undertakes to us that he will not use the hosting service
in any manner which infringes any law or regulation or which infringes the rights of
any third party, nor will he authorise or permit any other person to do so; and will
not post, link to or transmit (a) any material which is unlawful, threatening, abusive,
malicious, defamatory, obscene, pornographic, blasphemous, profane or otherwise
objectionable in any way; (b) any material containing a virus or other hostile
computer program; (c) any material which constitutes, or encourages the
commission of, a criminal offence or which infringes any patent, trade mark, design
right, copyright or any other intellectual property right or similar rights of any person
which may subsist under the laws of any jurisdiction.

The customer shall keep secure any identification, password and other confidential
information relating to his account and shall notify us immediately of any known or
suspected unauthorised use of his hosting service or breach of security, including
loss, theft or unauthorised disclosure of his password or other security information.

These conditions of hosting shall include any conditions to which B2B Web
Consultants may have agreed to abide by for and on behalf of their customers or to
which they are subject as third parties sub contractors or hirers in connection with
the provision of a service to their customers.

The customer agrees that he will not use or allow to be used the e-mail facilities
available through the service provided for the purposes of sending out bulk
unsolicited messages either directly or indirectly. Any email messages sent out to
lists of recipients must have been collected and compiled with the express consent
of those recipients.

Spamming, or the sending of bulk unsolicited email, from or through any of the
servers that we use is STRICTLY PROHIBITED.

While we will use every reasonable endeavour to ensure the integrity and security
of the servers from which our hosting service is supplied, we do not guarantee that
any server used by us will be free from unauthorised users or hackers or from
corruption by viruses and we shall be under no liability for non-receipt or misrouting
of email or for any other failure of email or damage to date or operations.

In using the hosting service provided by B2B Web Consultants the hirer agrees to
observe and not to transgress any law which relates to the use of the Internet, the
publication of web pages or the transmission of electronic mail, files, data or
information.

In the event of a customer being found to be in breach of these conditions of
service, the service may be withdrawn and may continue to be withheld until the
user can prove that any such breach or allegation of breach was in fact unjustified
or until such times as the customer gives a written undertaking that he will not
repeat any such breach. We make no representation and give no warranty as to the accuracy or quality of information received by any person via the Server and we shall have no liability for any loss of or damage to any data stored on the Server.

The customer is advised to effect and maintain adequate insurance cover in
respect of any loss of or damage to data stored on the Server.

In accepting a hosting service from B2B Web Consultants, the customer agrees to
indemnify them against any claims made or damages resulting from his use of the
service.

The customer warrants that he is at least 18 years of age and if the customer is a
company, warrants that the hosting service will not be used by anyone under the
age of 18 years.

The customer shall not in using the hosting service incur or purport to incur on our
behalf any liability nor in any way pledge or purport to pledge our credit or to make
any contract binding on us. Customers who fail to pay to us such fees and charges as they have agreed to pay and within a reasonable period of time agree that we may withdraw the service provided until such times as those fees and charges are fully and finally settled with us.

The laws of the United Kingdom shall apply to any contract or transactions
between B2B Web Consultants and its customers.
